Testing Drunk Drivers

Summit County Prosecutor Sherri Bevan Walsh is "leading an initiative to strengthen our DUI laws" regarding convicted drunk drivers. She says that people with a history of drunk driving often refuse a breathalyser or blood alcohol test. She would like to change the law to make it mandatory for repeat drunk drivers to take either a breathalyser or a blood alcohol test. Walsh is surveying Summit County residents to gauge how they feel about the issue. Click here to take the survey, which asks:

Where the police have probable cause to believe a person is driving while intoxicated, a breath or blood alcohol test would be mandatory by Ohio law if an individual...

Has 1 (one) prior conviction for DUI.
Has 2 (two) or more prior convictions for DUI.
Has caused serious physical harm or death to another person while driving even if no prior DUI record.
Is driving with a license that has been suspended for DUI.
None of the above. The law should not be changed.

What do you find acceptable? I think we should do what we can to keep repeated drunk drivers off the roads. Walsh mentions that some people have over 20 DUIs. Why are they still driving? Still, I'm not sure how to vote on this issue.

Some cars include a breathalyser for people who have had a certain number of DUIs. The car won't start without the driver passing the test. I like this solution. Prevention first.

A guy I used to work with had an in-car breathalyzer. He used to go to the bar, and just leave his car idling outside.

I've also seen drunk people just ask or pay soemone sober to blow into the breathalyzer.

Unless you give someone with multiple DUIs significant jailtime (which I don't really support) there isn't a good way to keep them off the road.

Having a breathalyser in your car doesn't stop police from pulling you over if you appear to be drunk.

How would you answer Walsh's question?

Arizona has about as harsh of laws as anywhere. I have seen people get 2.5 years for a 3rd DUI.

But what makes it impossible to beat a DUI in Arizona (and a few other states) is that the cops are certified phlebotomists that will draw your blood on site. That way, if you refuse to blow, the cop calls a judge that is on standby (24 hrs) that will approve a search warrant (of their blood). This is all done by fax.
Hence, it is pretty much impossible to get away with a DUI in AZ, unless the cops are idiots.

Seems a bit intrusive. But it does make defending a DUI more difficult. Hence, I think Ohio people would support this.

I read up some more.

- I don't quite understand this "require" people to blow or give blood. I presume they would still have to get a search warrant.

- The provision eliminating a phrase in the existing law that requires people to know or have ``reasonable cause to believe'' the person is drunk or lacks a valid license when LOANING a car is crap.

One aspect that seems to go overlooked is this:

Repeat offenders are addicted alcoholics (vice versa). They are addicted to drinking alcohol and are NOT able to stop. They will find a way to drive (drunk) until they are no longer addicted and using alcohol.

Maybe the law should approach this from the angle of drying out the addicted.???

Unfortunately, many alcoholics go to their graves addicted. The recovery rate is not very high, but the percentage that are rehabed successfully do NOT drive drunk anymore.

Chuck, the Ariz approach does the job form the law enforcement approach - so I say good.....but maybe more can be done on the rehab side.

Unfortunately, the medical "rehabbers" are mostly out for profit and the success rates are poor. What the hell have they to gain by actually curing and therefore losing a patient.

The AA has the BEST approach. God Bless the AA

That isnt necessarily true - I know someone under 30 who isn't realy an alcoholic, just an idiot, with at least 3 dui's. I agree they should appproach it differently, but I am not sure exactly what would be best.
